Aston Hill Bike Park – Riding & Attendance Terms and Conditions

Operated by Bike Park Chilterns CIC

These Terms and Conditions apply to all persons entering, riding at, accompanying another person to, or otherwise attending Aston Hill Bike Park (“Aston Hill” or the “Bike Park”), operated by Bike Park Chilterns CIC (“BPC”, “we”, “us”).

By booking, purchasing access, becoming a member or entering Aston Hill, you agree to comply with these Terms and Conditions, all applicable site rules and signage, and reasonable instructions given by BPC staff, contractors or authorised representatives.

1. Access and booking

Access to Aston Hill is subject to the Bike Park being open and to the applicable booking, membership and access requirements.

All riding sessions must be booked in advance. Every rider must hold a valid booking, membership allocation, day pass or other authorised riding entitlement for the session they attend.

Membership does not provide unrestricted access to Aston Hill and does not guarantee availability on any particular date or session.

BPC may restrict or suspend access to all or part of the Bike Park where reasonably necessary because of safety, trail maintenance, forestry operations, weather or ground conditions, events, environmental management, capacity, emergencies or other operational requirements.

Access outside published opening hours is prohibited unless expressly authorised by BPC.

2. Rider responsibility and inherent risk

Mountain biking is an inherently hazardous activity.

Aston Hill contains natural and constructed terrain and features which may include steep gradients, roots, rocks, loose or changing surfaces, drops, jumps, gaps, berms, technical sections, trees and other obstacles.

Conditions may change because of weather, use, maintenance, forestry operations and natural processes.

Riders are responsible for assessing trails and features before riding them and for riding within their own ability, experience and confidence, taking account of the prevailing conditions.

Trail grading provides general guidance only. It does not guarantee that every feature on a trail will be suitable for every rider.

Riders remain responsible for deciding whether they are capable of safely attempting a particular trail or feature.

Nothing in these Terms excludes or restricts any liability which cannot lawfully be excluded or restricted.

3. Bicycles and equipment

Riders are responsible for ensuring that their bicycle and other equipment are safe, suitable and appropriately maintained for the trails and features they intend to use.

A suitable cycling helmet must be worn whenever riding at Aston Hill.

BPC may specify additional protective equipment for particular trails, features, events, coaching sessions or other activities.

BPC may refuse riding access where a bicycle or equipment is obviously unsuitable or presents a material safety risk.

4. Trail rules

Riders must:

  • follow trail direction, signage, closures and instructions;
  • use trails appropriate to their ability and experience;
  • allow sufficient space between themselves and other riders;
  • stop only where they can be clearly seen and without obstructing a trail;
  • take reasonable care when joining, crossing or leaving trails;
  • use designated access, return and push-up routes where provided;
  • respect other riders, staff, volunteers and legitimate forest users;
  • not deliberately obstruct, alter or damage trails or features;
  • not construct or modify trails, jumps or other features without BPC’s express permission; and
  • not enter closed trails, construction areas, forestry work areas or other restricted areas.

Where a trail, feature or area is closed, the closure applies regardless of whether an individual rider considers it safe to enter or ride.

5. Minimum age and young riders

The minimum age for riding at Aston Hill is 8 years old.

Riders aged under 16 must be accompanied at Aston Hill by a responsible adult aged 18 or over for the duration of their visit.

The accompanying adult does not necessarily need to ride but must remain at Aston Hill and be available to take responsibility for the young rider.

Riders aged 8 to 11 inclusive must successfully complete a BPC assessment session before they may book or participate in general riding sessions.

Assessment sessions must be booked in advance.

Successful completion of an assessment confirms only that the rider has demonstrated the minimum level of riding ability and awareness required by BPC for participation in general sessions at the time of assessment. It does not confirm that every trail or feature at Aston Hill is suitable for that rider.

BPC may require a young rider to undertake a further assessment where there are reasonable concerns regarding their ability to use the facility safely.

A parent or guardian booking or purchasing access for a person under 18 is responsible for ensuring that the young person understands and complies with these Terms and any applicable site and trail rules.

Parents and guardians remain responsible for deciding which trails and features are appropriate for a young rider’s ability, experience and confidence.

Participation in coaching, assessment or another organised activity does not transfer general parental responsibility to BPC unless expressly agreed as part of that activity.

6. Drugs, alcohol and impairment

BPC operates a zero-tolerance approach to illegal drugs at Aston Hill.

Illegal drugs must not be brought onto, possessed, consumed, supplied or distributed anywhere within Aston Hill or other areas under BPC’s control.

Controlled substances may only be possessed or used where the person has lawful authority to do so.

No person may ride, supervise a young rider, operate machinery or undertake another safety-critical activity while impaired by alcohol, illegal drugs, medication or any other substance to an extent that may affect their judgement, reactions or ability to act safely.

Leaving the immediate riding area, trail network or activity in order to consume illegal drugs elsewhere on the Aston Hill site before returning does not provide an exception to these requirements.

BPC may refuse or withdraw access where it reasonably considers that a person’s condition or behaviour presents a safety, legal or operational risk.

7. Behaviour and conduct

Everyone attending Aston Hill must behave responsibly and respectfully towards other riders, visitors, BPC staff and volunteers, contractors, Forestry England personnel, neighbouring landowners and other legitimate users of the area.

BPC will not accept behaviour including:

  • bullying, intimidation or harassment;
  • threats or violence;
  • abusive, discriminatory or seriously disruptive behaviour;
  • deliberately dangerous riding around other people;
  • deliberate damage to BPC, Forestry England or another person’s property;
  • persistent refusal to follow reasonable instructions;
  • interference with BPC operations, staff or contractors;
  • behaviour creating a material risk to riders, visitors, staff, volunteers or members of the public; or
  • conduct which materially threatens BPC’s ability to operate Aston Hill or comply with its obligations to its landowner or other parties.

These requirements apply equally to riders and non-riders.

8. Parents, guardians, spectators and other visitors

These Terms apply to people attending Aston Hill whether or not they are riding.

Parents, guardians, spectators and other visitors must comply with site rules, signage and reasonable instructions from BPC.

Non-riding attendance does not create a right to enter trails, construction areas, operational areas, forestry work areas or other restricted parts of the site.

The behaviour of accompanying adults must not create a safety risk or materially interfere with riding activities or the operation of the Bike Park.

9. Coaching and organised activities

Commercial coaching, guiding, events, organised group activities and other commercial use of Aston Hill require BPC’s prior approval unless provided directly by BPC.

An invitation from an external coach, club, group or other third party does not override BPC’s site rules or create an independent right of access.

Participants in externally operated coaching or activities remain subject to these Terms and Conditions.

BPC may impose additional conditions upon coaching, events or organised activities where reasonably required for safety or operational purposes.

10. Forestry operations and other land users

Aston Hill operates within a working forest environment.

Forestry operations, land management, emergency access and other authorised activities may take priority over recreational use.

Riders and visitors must respect site boundaries, neighbouring land, public rights of way and other legitimate users of the surrounding area.

Bicycles must not be ridden onto neighbouring private land or into areas where cycling is prohibited.

Instructions or closures arising from Forestry England or other authorised land-management activity must be followed.

11. Parking and vehicle access

Parking at Aston Hill is strictly limited and must be booked in advance.

Any person intending to arrive at Aston Hill by car and park at the Bike Park must reserve a parking space when purchasing or booking their riding session.

This requirement applies to members and day-pass riders alike. Membership does not include or guarantee parking.

Where Aston Hill parking is unavailable, riders may:

  • travel to Aston Hill by bicycle or another permitted means and book ride-only access; or
  • park at the main Wendover Woods car park and travel onwards to Aston Hill using the permitted access arrangements.

A ride-only booking must not be used as a means of circumventing Aston Hill’s parking restrictions.

Anyone selecting ride-only access confirms that they will not park a vehicle at Aston Hill, on the road leading to Aston Hill or in another unauthorised location associated with their visit.

Vehicles associated with Aston Hill users must not be parked:

  • on any part of the road leading to Aston Hill;
  • on road verges or passing places;
  • in gateways or forestry access points;
  • on neighbouring land;
  • in areas reserved for emergency or operational access; or
  • in any other location not expressly authorised for visitor parking.

Vehicles must not obstruct highways, emergency access, forestry operations, neighbouring properties, entrances or other road users.

BPC may record vehicle registration details for the purposes of administering parking, managing access and enforcing these Terms, in accordance with BPC’s applicable privacy policy.

Where a vehicle associated with a rider or visitor is found parked in an unauthorised location, BPC may take enforcement action against the associated booking holder, member or visitor.

Depending upon the circumstances and whether the behaviour is repeated, action may include a warning, suspension of parking privileges, suspension of riding access, fixed-term exclusion from Aston Hill or indefinite withdrawal of access.

Deliberately circumventing the parking booking system may itself result in suspension or withdrawal of access.

Serious obstruction of emergency, forestry or operational access may result in immediate suspension or exclusion without a prior warning.

Visitors must arrive and depart considerately, particularly in relation to vehicle speed, noise, litter and neighbouring properties.

12. Litter and the environment

Visitors must dispose of waste responsibly using facilities provided or take it away with them.

Littering, dumping, deliberate environmental damage and interference with wildlife or habitat are prohibited.

Visitors must not remove, damage or interfere with trees, vegetation, fencing, signage or other infrastructure except where expressly authorised.

BPC may introduce additional environmental controls where reasonably necessary to protect the woodland, manage fire or environmental risk, or comply with landowner or statutory requirements.

13. Smoking, vaping and fire

Smoking and vaping are only permitted where and when expressly allowed by BPC.

Open fires, disposable barbecues and other unauthorised sources of ignition are prohibited.

BPC may prohibit smoking and vaping throughout all or part of Aston Hill where required because of fire risk, forestry restrictions or other operational considerations.

14. Photography, filming and drones

Personal photography and filming are generally permitted provided that doing so does not interfere with other users, BPC operations or safety.

Commercial filming, organised content production, professional photography requiring controlled access and drone operation require BPC’s prior permission and may also require permission from Forestry England or other relevant parties.

Visitors must respect the privacy of other users, particularly children and young people.

BPC may capture photography or video for operational, safety or promotional purposes. Where identifiable individuals are the principal subject of promotional content, appropriate permissions will be obtained where required.

15. Accidents, incidents and hazards

Accidents, significant near misses, damaged trail features and hazards should be reported to BPC as soon as reasonably practicable.

Visitors must follow reasonable instructions from BPC during an incident or emergency.

Emergency and operational access routes must be kept clear at all times.

BPC may close any trail, feature or area following an incident while it is inspected, repaired or otherwise made suitable for reopening.

16. Suspension and withdrawal of access

BPC may refuse entry, require a person to leave, suspend access or withdraw access where reasonably necessary because of:

  • serious or repeated breach of these Terms;
  • dangerous behaviour;
  • illegal drug possession, supply or use;
  • violence, threats, bullying, intimidation or harassment;
  • deliberate entry onto closed trails or restricted areas;
  • deliberate damage to trails, property or the environment;
  • unauthorised parking;
  • deliberate circumvention of the parking booking system;
  • obstruction of roads, emergency access, forestry access or neighbouring property;
  • material risk to other users or the operation of Aston Hill; or
  • persistent refusal to comply with reasonable instructions.

Depending upon the circumstances, BPC may issue a warning, temporarily suspend access, impose a fixed-term exclusion or withdraw access indefinitely.

BPC may take immediate action without first issuing a warning where the seriousness of the conduct reasonably justifies it.

Where membership or other paid access is suspended or withdrawn because of the user’s own serious or repeated misconduct, BPC will not normally provide a refund for the affected period, subject always to the user’s statutory rights.

Where appropriate, BPC may impose conditions upon future access following a suspension or conduct incident.

17. Memberships, passes and bookings

Memberships, passes and bookings are also subject to BPC’s applicable Membership and Booking Terms and Conditions.

These Riding & Attendance Terms govern conduct and use of Aston Hill and therefore apply regardless of whether a person enters as a member, day-pass rider, coaching participant, guest, parent, guardian, spectator or other authorised visitor.

A membership, booking or payment does not override BPC’s safety, conduct, parking or operational requirements.

Access rights are personal to the person for whom the booking, pass or membership has been issued and must not be transferred unless expressly permitted by BPC.

18. Closures and interruptions

Aston Hill is an outdoor facility within a working forest and closures or restrictions will sometimes be necessary.

BPC may close or restrict all or part of Aston Hill because of severe weather, ground conditions, forestry operations, maintenance, emergencies, events, landowner requirements, environmental considerations or other circumstances reasonably affecting safe or lawful operation.

Short-term closures and individual trail or feature closures form part of the normal operation of an outdoor mountain-bike facility and do not automatically create an entitlement to compensation or refund.

Where a closure materially affects a paid booking or causes a substantial extended interruption to a membership, BPC will apply its applicable Booking or Membership Terms together with the user’s statutory rights.

19. Personal property

Visitors remain responsible for their bicycles, vehicles, equipment and personal possessions while attending Aston Hill.

BPC is not responsible for loss, theft or damage except to the extent that liability arises from BPC’s negligence or where liability cannot lawfully be excluded or restricted.

Bicycles and other property must not be left where they obstruct trails, access routes, emergency routes or BPC operations.

20. Site rules and instructions

BPC may introduce reasonable site rules, temporary restrictions and safety requirements from time to time.

These may be communicated through signage, booking information, BPC’s website, email or instructions from BPC staff or authorised representatives.

Visitors must comply with such requirements while they apply.

An individual user cannot substitute their own alternative arrangement for a BPC access, safety, parking or conduct requirement unless that alternative has been expressly agreed by BPC in advance.

21. Changes to these Terms

BPC may make reasonable changes to these Terms where necessary to reflect changes in law, landowner requirements, insurance requirements, facilities, trail provision or BPC’s operational and safety arrangements.

Where a change materially affects an existing membership or other ongoing paid service, BPC will communicate the change where reasonably appropriate and will continue to respect applicable statutory rights.
